Three distinct entitlements with different lengths, different pay and different eligibility rules — and the interaction between them, particularly shared parental leave, is where most of the confusion sits.

Maternity leave. Up to 52 weeks, available to employees from day one of employment — no qualifying service is needed for the leave itself.

The first two weeks after birth are compulsory, and four for factory workers. Statutory Maternity Pay, where eligibility criteria on service and earnings are met, runs for up to 39 weeks: a higher rate based on earnings for the first six weeks, then a flat rate. The remaining 13 weeks are unpaid.

Maternity Allowance is the alternative for those who do not qualify for SMP, including many self-employed people.

Paternity leave. One or two weeks, at a flat rate, for eligible employees — and the contrast is the point: two weeks against fifty-two. Uptake is limited both by the length and by the rate, which for many households is unaffordable.

Shared parental leave. Allows a mother to curtail her maternity leave and share the remaining balance with a partner — up to 50 weeks of leave and 37 weeks of pay between them.

Its genuine flexibility: it can be taken in up to three separate blocks each, at the same time as each other or at different times, which maternity leave alone does not allow.

Why take-up has been persistently low: it is administratively complex, requires the mother to give up leave rather than creating a new entitlement, is paid at the flat rate, and eligibility depends on both parents' circumstances. These are structural rather than attitudinal problems.

Adoption leave broadly mirrors maternity leave, and neonatal care leave is a newer separate entitlement.

What applies throughout: holiday continues to accrue; the contract continues; keeping-in-touch days are permitted without ending leave; you are entitled to return to the same job after 26 weeks, or a suitable equivalent after longer; and redundancy protections extend beyond the leave period.
