Can you be fined for taking a child out of school?
Yes. Term-time absence without authorisation can result in a penalty notice, and the rules were tightened and made more consistent across England from August 2024.
The legal position. Parents have a duty to ensure their child attends regularly where the child is registered at a school. Head teachers may authorise absence only in exceptional circumstances, and regulations explicitly removed any general entitlement to term-time holiday — the frequently believed "ten days a year" has no basis and never did.
What "exceptional" means is decided by the head teacher, and typically covers bereavement, some religious observance, service personnel returning from deployment, and particular family circumstances. Cost is not an exceptional circumstance, however substantial the price difference, and this is the point most disputed by parents.
The national framework from August 2024:
A penalty notice must be considered where a pupil has a defined number of unauthorised absence sessions — a session being half a day — within a rolling period.
A national fine amount applies, payable per parent per child, at a lower rate if paid within a short window and a higher rate thereafter.
A second notice for the same child within three years is charged at the higher rate immediately.
No more than two notices may be issued for the same child within three years — beyond that, the authority must consider other action, including prosecution.
Check current figures and thresholds, since the amounts are set nationally and reviewed.
Prosecution under the Education Act can follow persistent absence, with the possibility of a substantially larger fine, a community order or, in the most serious cases, imprisonment. Prosecutions do occur.
Other absence categories: illness is normally authorised, though schools may request evidence where absence is frequent; medical and dental appointments should be outside school hours where possible; and religious observance for a day set apart by the family's religious body is a specific statutory category.
Attendance is recorded as persistent absence below a threshold of possible sessions attended, which triggers school and authority intervention before fines arise.
